One of the biggest victories for construction employers this year was Chamber of Commerce v. Brown, which struck down a California law prohibiting employers from using state funds to discuss union organization efforts with employees. Amar Sarwal, general litigation counsel for the U.S. Chamber of Commerce, says the case is significant because about 20 other states either have enacted or are considering similar laws. “You have a situation where this case is going to have an impact beyond just this one decision,” he says.
